Since the beginning of 2017, Russia has introduced new forms of medical certificates for weapons - 002-О/у and 003-О/у. Nevertheless, the old certificate number 046-1 is still in force. I will tell you how to get each of them below.

We are all different, we all have our own opinions. Some people think that it’s better to feed early in the morning, while others think it’s best to feed in the evening. Someone always hits on takeoff, and someone only hits when the flight is already stable, goes smoothly and you can more accurately take a lead.

Sometimes running around for these certificates and documents, including medical ones, is very annoying, and most importantly, you don’t understand at all why it is needed.

But what everyone everywhere agrees on is that obtaining a medical certificate, as the first step towards acquiring a weapon, no matter what kind, hunting, traumatic (with a muzzle power of more than 7.5 J, I emphasize), is required.

The consequences of the use of weapons by people who are mentally unbalanced, who have diseases that do not allow the sick person to precisely control the situation around them are too severe.

What the law says

It is precisely in view of the seriousness of the situation in medicine and the process of obtaining a certificate that the Law “On Weapons” No. 150-FZ of December 13, 1996 devotes an entire article - the 13th. And, precisely in view of the seriousness of the issue, I will quote one by one excerpts from this article concerning the topic of medical certificates (as amended on July 6, 2016). Please note that excerpts from the law are taken in italics and a different font. Firstly, it immediately says that “the right to purchase civilian firearms of limited destruction have

  • citizens Russian Federation who have reached the age of 21,
  • citizens of the Russian Federation who have not reached the age of 21, who have completed or are undergoing military service,
  • as well as citizens serving in state paramilitary organizations and having military ranks or special titles or class ranks of justice".

On the other side,

"right to acquire gas weapons, firearms, smooth-bore long-barreled self-defense weapons, sports weapons, hunting weapons, signal weapons, bladed weapons intended for wearing with the national costumes of the peoples of the Russian Federation or Cossack uniform, are owned by citizens of the Russian Federation who have reached the age of 18 years.”.

Please note that some regions of Russia have made their own changes and additions to this law, more fully reflecting the cultural traditions of the peoples living in the region. Thus, in some regions it is allowed to reduce the minimum age for obtaining weapons, but this must be done with a special permit and only for smooth-bore hunting weapons. The reduction period cannot be more than 2 years.

In addition to all other documents required when obtaining a weapons license, it is also necessary to provide

“The list of diseases, the presence of which prohibits the possession of weapons, is determined by the Government of the Russian Federation. Order of conduct medical examination, the form of a medical report on the absence of medical contraindications to the possession of weapons and the form of a medical report on the absence of narcotic drugs, psychotropic substances and their metabolites in the human body are established by the federal executive body exercising the functions of developing state policy and legal regulation in the field of healthcare.”

“The validity period of a medical certificate stating that there are no medical contraindications to owning a weapon for obtaining a license to purchase a weapon is one year from the date of its issue. Examination by a psychiatrist, a psychiatrist-narcologist during a medical examination for the presence of medical contraindications to the possession of weapons and chemical and toxicological studies of the presence of narcotic drugs, psychotropic substances and their metabolites in the human body are carried out in medical organizations of the state or municipal health care system at the place of residence (stay) of a citizen of the Russian Federation.”

“Medical examination for the presence of medical contraindications to the possession of weapons and chemical and toxicological studies of the presence of narcotic drugs, psychotropic substances and their metabolites in the human body are carried out at the expense of citizens.”

I advise you to pay special attention to the latter.

From the words of lawyers to medical matters

In other words, there is no point in showing up to obtain a weapons license if you do not have a certificate signed:

  1. A therapist.
  2. A psychiatrist.
  3. Narcologist, and
  4. An ophthalmologist.

In addition to obvious health conditions such as epilepsy and drug addiction, certificate is not issued:

  • If the patient is susceptible to diseases of the nervous system;
  • If one eye is completely blind;
  • If visual acuity in one eye is no more than 0.5, and in the other eye no more than 0.2;
  • If there are no three fingers on the hand;
  • If there is no index finger and thumb on the hand.

All medical professionals must clearly understand for what purpose the certificate is being issued and where it will be presented. Moreover, I note that in the chain of passing doctors, the therapist is in last place, it is he who issues the final permission.

Enough for a long time the standard form of medical “weapons” certificate No. 046-1 was in use. On January 1, 2017, it was canceled, and two others were introduced, 002 and 003. But no matter what form the certificate is, it is some kind of guarantee that obviously sick or frivolous people will not be allowed to own weapons. Please note that the medical certificate described is issued for a fee, so you must first make sure whether the institution you applied to, and these can be both public and private clinics, has the right to issue such documents.

The validity period of a medical certificate is 6 months, this is a well-known fact. Therefore, the 1-year period specified in the Law is cause for concern. I strongly recommend that you further discuss all these nuances in your region when it comes to the therapist.

New certificates

So, from January 1, 2017, new forms of medical certificates were introduced. At the same time, the old certificates 046-1 continue to be valid (let’s not forget about the general expiration date of six months, in other words, these certificates were issued after July 1, 2016, and they “live” until a maximum of June 30, 2017).

Two new certificates are already called more reputably - conclusions, and have numbers - 002-О/у and 003-О/у.

The procedure and conditions for issuing these certificates are determined by Order of the Ministry of Health of Russia No. 441n dated June 30, 2016 “On the procedure for conducting a medical examination for medical contraindications to gun ownership and chemical and toxicological studies of the presence of narcotic drugs, psychotropic substances and their metabolites in the human body.”

Please note that the list of doctors remains the same, but to obtain certificate 002-О/у you must also present certificate 003-О/у along with the relevant conclusions.

and precedes

002-O/u, whose name is “Medical report on the absence of medical contraindications to owning a weapon.”

I would also like to draw your attention, given how much confusion and misunderstanding there is in this area, that the same order dated June 30, 2016 cancels the Resolutions of the Ministry of Health

  • No. 344 of September 11, 2000 - “On medical examination of citizens for the issuance of a license for the right to purchase weapons” (registered by the Ministry of Justice of the Russian Federation on October 10, 2000, registration No. 2415);
  • No. 512n dated July 12, 2010 “On amendments to the order of the Ministry of Health of the Russian Federation dated September 11, 2000 No. 344 “On medical examination of citizens for the issuance of licenses for the right to purchase weapons” (registered by the Ministry of Justice of the Russian Federation on August 30, 2010, registration No. 18287).

One hidden but important flaw in all orders

And this is a small, but significant, vital chapter, behind which, however, lies many problems.

The fact is that the Federal Law clearly states that certificates for the right to own weapons are obtained for a fee. But the law does not determine the amount of payment itself, which gives rise to many problems on the ground.

And the situation is such that each region of Russia does whatever it wants. There is no uniform rate for the provision of this service across the country.- somewhere it costs 800 rubles, and somewhere under 4 thousand.

Nuances and conclusions, and where would we be without them?

Now I will list some of the nuances associated with obtaining submitted medical certificates. If you listen to these recommendations, life will seem much more interesting to you.

Firstly, you need to see a narcologist and psychologist only at a medical institution at your place of residence. Secondly, certificate 003-О/у is issued only on the basis of the conclusion of a chemical-toxicological study and the preparation of form No. 454/у-06. Simply put, you will need to submit a urine test to the dispensary. Passing this test is necessary procedure for all those applying for certificate form No. 003-О/у. Without this test, this certificate will not be issued.

Thus, as a conclusion and conclusion, with which medicine sends you to the commission in charge of weapons licenses:

  • medical certificate in form No. 002-О/у dated June 30, 2016 (for the right to own a weapon);
  • medical certificate in form No. 003-О/у dated June 30, 2016 (certifying the absence of drugs in the body);

2. Establish that a medical report on the absence of medical contraindications to owning a weapon is a protected printing product of level “B”.

3. To recognize as invalid:

3. Chemical-toxicological studies are carried out for the purpose of detection and subsequent identification of narcotic drugs, psychotropic substances and their metabolites in samples of biological objects (urine).

4. Medical examination is carried out in medical and other organizations engaged in medical activities (hereinafter referred to as medical organizations), regardless of their organizational and legal form, which have a license to carry out medical activities that include the performance of work (services) for “medical examination for the presence of medical contraindications to the possession of weapons", "ophthalmology".

5. Examination by a psychiatrist during a medical examination is carried out in medical organization state or municipal health care systems at the place of residence (stay) of a citizen of the Russian Federation undergoing a medical examination (hereinafter referred to as the examinee), who has a license to carry out medical activities that include the performance of work (services) in “psychiatry” and “psychiatric examination.”

6. An examination by a psychiatrist-narcologist during a medical examination, as well as a qualitative and quantitative determination of carbohydrate-deficient transferrin (CDT) in the blood serum of the examinee, is carried out in medical organizations of the state or municipal health care systems at the place of residence (stay) of the examinee, which have a license for the implementation of medical activities involving the performance of work (services) in “psychiatry-narcology” and “ laboratory diagnostics"or "clinical laboratory diagnostics".

7. Medical examination includes medical examinations by medical specialists and laboratory testing in the following scope:

medical examination by an ophthalmologist;

medical examination by a psychiatrist;

medical examination by a psychiatrist-narcologist;

qualitative and quantitative determination of carbohydrate-deficient transferrin (CDT) in the blood serum of the subject (if a psychiatrist-narcologist identifies symptoms and syndromes of the disease, in the presence of which possession of a weapon is contraindicated).

8. Chemical and toxicological studies are carried out in drug treatment clinics(narcological hospitals) or other medical organizations of the state or municipal health care system at the place of residence (stay) of the person being examined, having a license to carry out medical activities involving the performance of work (services) on “clinical laboratory diagnostics” or “ forensic medical examination material evidence and the study of biological objects (biochemical, genetic, medical-forensic, spectrographic, forensic-biological, forensic-histological, forensic-chemical, forensic-cytological, chemical-toxicological).”

9. Medical examination and chemical-toxicological studies are carried out at the expense of citizens.

10. Chemical-toxicological studies are carried out in two stages: preliminary chemical-toxicological studies using immunochemical methods using analyzers that provide registration and quantification research results by comparing the obtained result with the calibration curve;

confirming chemical and toxicological studies using gas and (or) liquid chromatography with mass spectrometric detection using technical means that ensure registration and processing of research results by comparing the results obtained with data from electronic libraries of mass spectra.

11. Preliminary chemical and toxicological studies are carried out no later than 24 hours from the moment of collection of a biological object (urine) in a clinical diagnostic laboratory or chemical and toxicological laboratory of medical organizations specified in this Procedure.

12. Confirmatory chemical and toxicological studies are carried out in chemical and toxicological laboratories of medical organizations specified in this Procedure.

13. Chemical-toxicological research is mandatory for the following chemical substances, including their derivatives, metabolites and analogs: opiates, plant and synthetic cannabinoids, phenylalkylamines (amphetamine, methamphetamine), synthetic cathinones, cocaine and methadone, benzodiazepines, barbiturates.

Chemical toxicological testing is carried out for other substances that may cause adverse consequences during activities associated with a source of increased danger.

14. The medical registrar of one of the medical organizations specified in this Procedure, to which the person being examined applied for a medical examination, on the basis of a document proving his identity:

selects (or fills in) Medical card patient receiving medical care on an outpatient basis (form No. 025/u), and issues to the person being examined a medical report form stating that there are no medical contraindications to owning a weapon, the form of which is provided in Appendix No. 2 to this order, filled out on the basis of the identity document of the person being examined;

informs the person being examined about the list medical examinations medical specialists and laboratory tests that must be completed as part of a medical examination, and the need to undergo a chemical and toxicological study.

15. The referral for chemical toxicological research (registration form No. 452/u-06) is filled out according to the form and in accordance with the instructions, which are approved by order of the Ministry of Health and Social Development of the Russian Federation dated January 27, 2006 No. 40 “On the organization of chemical testing -toxicological studies for analytical diagnostics of the presence of alcohol, narcotic drugs, psychotropic and other substances in the human body toxic substances"(registered by the Ministry of Justice of the Russian Federation on February 26, 2006, registration No. 7544), and is issued to the person being examined by a psychiatrist-narcologist in a medical organization specified in this Procedure.

16. The collection of samples of a biological object (urine) for sending for chemical-toxicological testing is carried out in a volume of at least 30 ml in a disposable container for collecting urine in the toilet room of the medical organization specified in this Procedure.

17. In order to exclude falsification of a sample of a biological object (urine), the following measurements are carried out during the first 5 minutes after its collection:

temperature using a non-contact device with automatic registration of measurement results (normally, the temperature should be in the range of 32.5-39.0 ° C);

pH using a pH meter or universal indicator paper (normally pH should be in the range 4 - 8);

relative density (normally the relative density should be in the range of 1.008-1.025).

18. Upon completion of the preliminary chemical-toxicological study, if the biological object (urine) does not contain narcotic drugs, psychotropic substances and their metabolites in the sample, a confirmatory chemical-toxicological study is not carried out.

At the end of the preliminary chemical-toxicological study, if a biological object (urine) contains narcotic drugs, psychotropic substances and their metabolites in the sample, and regardless of their concentration, a confirmatory chemical-toxicological study is carried out. The delivery time for a sample of a biological object (urine) to a medical organization conducting a confirmatory chemical-toxicological study should not exceed 10 working days from the date of collection of the sample of a biological object (urine).

19. The period for conducting a confirmatory chemical-toxicological study should not exceed 3 working days from the moment the sample of the biological object (urine) is received by the chemical-toxicological laboratory.

20. Samples of biological objects (urine) are stored in a chemical-toxicological laboratory for 3 months from the date of conducting confirmatory chemical-toxicological studies, and the resulting mass spectra are stored in in electronic format within five years.

21. The results of chemical and toxicological studies are reflected in a certificate of the results of chemical and toxicological studies (registration form No. 454/u-06), which is drawn up in the form and manner approved by the order of the Ministry of Health and Social Development of the Russian Federation dated January 27, 2006. No. 40 “On the organization of chemical-toxicological studies for analytical diagnostics of the presence of alcohol, narcotic drugs, psychotropic and other toxic substances in the human body” (registered by the Ministry of Justice of the Russian Federation on February 26, 2006, registration No. 7544) and is submitted to the medical organization, sent a sample of a biological object (urine) to the chemical-toxicological laboratory.

At the request of the person being examined at the medical organization specified in this Procedure, he is given a copy of a certificate of the results of chemical and toxicological studies.

22. If, based on the results of a chemical-toxicological study, there are no narcotic drugs, psychotropic substances and their metabolites in the sample of a biological object (urine), a psychiatrist-narcologist of the medical organization specified in this Procedure shall issue a medical report on the absence of narcotic drugs in the human body, psychotropic substances and their metabolites, the form of which is provided for this order, in two copies. One copy of the specified medical report is given to the examinee, the second copy is entered by the psychiatrist-narcologist of the medical organization specified in paragraph 6 of this Procedure into the Medical record of the patient receiving medical care on an outpatient basis (form No. 025/u).

If narcotic drugs, psychotropic substances and their metabolites are detected in a sample of a biological object (urine), the absence of narcotic drugs, psychotropic substances and their metabolites in the human body is not recorded.

23. If, during an examination by a psychiatrist, symptoms and syndromes of a disease are identified in the examined person, the presence of which is contraindicated in the possession of weapons, the examined person is sent for a psychiatric examination by a medical commission of a medical organization authorized by the federal executive body in the field of healthcare or the executive body of the subject. of the Russian Federation in the field of healthcare, in accordance with Article 6 of the Law of the Russian Federation of July 2, 1992 No. 3185-1 “On psychiatric care and guarantees of citizens’ rights during its provision” (Vedomosti Congress people's deputies Russian Federation and the Supreme Council of the Russian Federation, 1992, No. 33, art. 1913, 2013, No. 48, art. 6165).

If the person being examined refuses to undergo the specified psychiatric examination, a certificate based on the results of the examination by a psychiatrist will not be issued.

24. Certificates based on the results of examinations by a psychiatrist, a psychiatrist-narcologist and an ophthalmologist are issued in accordance with the order of the Ministry of Health and Social Development of the Russian Federation dated May 2, 2012 No. 441n “On approval of the Procedure for issuing certificates and medical reports by medical organizations "(registered by the Ministry of Justice of the Russian Federation on May 29, 2012, registration No. 24366).

25. The results of medical examinations carried out as part of the medical examination (including certificates based on the results of examinations by a psychiatrist, a psychiatrist-narcologist and an ophthalmologist) and laboratory research, as well as a reasoned conclusion about the presence (absence) of medical contraindications to owning a weapon are entered by the doctor of the medical organization specified in this Procedure into the Medical record of the patient receiving medical care on an outpatient basis (form No. 025/u).

If the person being examined refuses to undergo a medical examination or to undergo at least one of the medical examinations by medical specialists and laboratory tests provided for in this Procedure, as well as a chemical and toxicological study, issued in accordance with Article 20 of the Federal Law of November 21, 2011 No. 323 -FZ “On the fundamentals of protecting the health of citizens in the Russian Federation” (Collected Legislation of the Russian Federation, 2011, No. 48, Art. 6724; 2013, No. 48, Art. 6165), a medical report on the absence of medical contraindications to gun ownership is not issued.

27. Issued medical reports on the absence of medical contraindications to owning a weapon are subject to mandatory registration in the Register of issued medical reports on the absence of medical contraindications to owning a weapon, the form of which is provided for this order.

From January 1, 2017, forms of medical reports N002-О/у and N003-О/у on the absence of medical contraindications to owning weapons will come into effect. The procedure for conducting a medical examination for the presence of medical contraindications to the possession of weapons and chemical and toxicological studies of the presence of narcotic drugs, psychotropic substances and their metabolites in the human body

1. This procedure regulates the issues of conducting a medical examination for the presence of medical contraindications to the possession of weapons (hereinafter - medical examination) and chemical and toxicological studies of the presence of narcotic drugs, psychotropic substances and their metabolites in the human body (hereinafter - chemical and toxicological studies).

2. A medical examination is carried out in order to establish in a citizen of the Russian Federation who intends to own a weapon the presence (absence) of diseases included in the List of diseases, the presence of which prohibits the possession of weapons, approved by Decree of the Government of the Russian Federation of February 19, 2015 N 143.

3. Chemical-toxicological studies are carried out for the purpose of detection and subsequent identification of narcotic drugs, psychotropic substances and their metabolites in samples of biological objects (urine).

4. Medical examination is carried out in medical and other organizations engaged in medical activities (hereinafter referred to as medical organizations), regardless of their organizational and legal form, which have a license to carry out medical activities that include the performance of work (services) for “medical examination for the presence of medical contraindications to the possession of weapons", "ophthalmology".

5. An examination by a psychiatrist during a medical examination is carried out in a medical organization of the state or municipal health care system at the place of residence (stay) of a citizen of the Russian Federation undergoing a medical examination (hereinafter referred to as the person being examined), which has a license to carry out medical activities involving the performance of work (services) ) in "psychiatry" and "psychiatric examination".

6. An examination by a psychiatrist-narcologist during a medical examination, as well as a qualitative and quantitative determination of carbohydrate-deficient transferrin (CDT) in the blood serum of the examinee, is carried out in medical organizations of the state or municipal health care systems at the place of residence (stay) of the examinee, which have a license for the implementation of medical activities involving the performance of work (services) in “psychiatry-narcology” and “laboratory diagnostics” or “clinical laboratory diagnostics”.

7. Medical examination includes medical examinations by medical specialists and laboratory testing in the following scope:

medical examination by an ophthalmologist;

medical examination by a psychiatrist;

medical examination by a psychiatrist-narcologist;

qualitative and quantitative determination of carbohydrate-deficient transferrin (CDT) in the blood serum of the subject (if a psychiatrist-narcologist identifies symptoms and syndromes of the disease, in the presence of which possession of a weapon is contraindicated).

8. Chemical-toxicological studies are carried out in drug treatment clinics (narcological hospitals) or other medical organizations of the state or municipal health care system at the place of residence (stay) of the person being examined, which have a license to carry out medical activities that include performing work (services) on “clinical laboratory diagnostics” or “forensic medical examination of physical evidence and the study of biological objects (biochemical, genetic, medical-forensic, spectrographic, forensic biological, forensic histological, forensic chemical, forensic cytological, chemical toxicological).”

9. Medical examination and chemical-toxicological studies are carried out at the expense of citizens.

10. Chemical and toxicological studies are carried out in two stages:

preliminary chemical and toxicological studies using immunochemical methods using analyzers that provide registration and quantitative assessment of research results by comparing the obtained result with a calibration curve;

confirming chemical and toxicological studies using gas and (or) liquid chromatography with mass spectrometric detection using technical means that ensure registration and processing of research results by comparing the results obtained with data from electronic libraries of mass spectra.

11. Preliminary chemical and toxicological studies are carried out no later than 24 hours from the moment of collection of the biological object (urine) in a clinical diagnostic laboratory or chemical and toxicological laboratory of medical organizations specified in paragraph 8 of this Procedure.

12. Confirmatory chemical and toxicological studies are carried out in chemical and toxicological laboratories of medical organizations specified in paragraph 8 of this Procedure.

13. Chemical-toxicological testing is mandatory for the following chemical substances, including their derivatives, metabolites and analogues: opiates, plant and synthetic cannabinoids, phenylalkylamines (amphetamine, methamphetamine), synthetic cathinones, cocaine and methadone, benzodiazepines, barbiturates.

Chemical-toxicological research is carried out on other substances that may lead to adverse consequences during activities associated with a source of increased danger.

14. The medical registrar of one of the medical organizations specified in paragraphs 4-6 of this Procedure, to which the examinee applied for a medical examination, on the basis of an identification document:

selects (or fills out) a medical record of a patient receiving medical care on an outpatient basis (form N 025/у), and issues to the person being examined a medical report form on the absence of medical contraindications to owning a weapon, the form of which is provided for in Appendix No. 2 to this order, with completed based on the identity document of the person being examined, lines 1-3;

informs the person being examined about the list of medical examinations by medical specialists and laboratory tests that must be completed as part of the medical examination, and about the need to undergo a chemical-toxicological test.

15. The referral for chemical toxicological research (registration form N 452/u-06) is filled out in accordance with the form and in accordance with the instructions, which are approved by order of the Ministry of Health and Social Development of the Russian Federation dated January 27, 2006 N 40 “On the organization of chemical testing” toxicological studies for analytical diagnosis of the presence of alcohol, narcotic drugs, psychotropic and other toxic substances in the human body" (registered by the Ministry of Justice of the Russian Federation on February 26, 2006, registration N 7544), and is issued to the person being examined by a psychiatrist-narcologist in a medical organization specified in paragraph 6 of this Procedure.

16. The collection of samples of a biological object (urine) for sending for chemical-toxicological testing is carried out in a volume of at least 30 ml in a disposable container for collecting urine in the toilet room of the medical organization specified in paragraph 6 of this Procedure.

17. In order to exclude falsification of a sample of a biological object (urine), the following measurements are carried out during the first 5 minutes after its collection:

temperature using a non-contact device with automatic registration of measurement results (normally, the temperature should be in the range of 32.5-39.0 ° C);

pH using a pH meter or universal indicator paper (normally pH should be in the range of 4-8);

relative density (normally the relative density should be in the range of 1.008-1.025).

18. Upon completion of the preliminary chemical-toxicological study, if the biological object (urine) does not contain narcotic drugs, psychotropic substances and their metabolites in the sample, a confirmatory chemical-toxicological study is not carried out.

At the end of the preliminary chemical-toxicological study, if a biological object (urine) contains narcotic drugs, psychotropic substances and their metabolites in the sample, and regardless of their concentration, a confirmatory chemical-toxicological study is carried out. The delivery time for a sample of a biological object (urine) to a medical organization conducting a confirmatory chemical-toxicological study should not exceed 10 working days from the date of collection of the sample of a biological object (urine).

19. The period for conducting a confirmatory chemical-toxicological study should not exceed 3 working days from the moment the sample of the biological object (urine) is received by the chemical-toxicological laboratory.

20. Samples of biological objects (urine) are stored in a chemical-toxicological laboratory for 3 months from the date of conducting confirmatory chemical-toxicological studies, and the resulting mass spectra are stored in electronic form for five years.

21. The results of chemical and toxicological studies are reflected in a certificate of the results of chemical and toxicological studies (registration form N 454/u-06), which is drawn up in the form and in the manner approved by order of the Ministry of Health and Social Development of the Russian Federation dated January 27, 2006 N 40 “On the organization of chemical-toxicological studies for analytical diagnostics of the presence of alcohol, narcotic drugs, psychotropic and other toxic substances in the human body” (registered by the Ministry of Justice of the Russian Federation on February 26, 2006, registration N 7544) and is submitted to the medical organization that sent the chemical and toxicological laboratory sample of a biological object (urine).

At the request of the person being examined at the medical organization specified in paragraph 6 of this Procedure, he is given a copy of a certificate of the results of chemical and toxicological studies.

22. If, based on the results of a chemical-toxicological study, there are no narcotic drugs, psychotropic substances and their metabolites in a sample of a biological object (urine), a psychiatrist-narcologist of the medical organization specified in paragraph 6 of this Procedure shall issue a medical report on the absence of narcotic drugs in the human body drugs, psychotropic substances and their metabolites, the form of which is provided in Appendix No. 4 to this order, in two copies. One copy of the specified medical report is given to the examinee, the second copy is entered by the psychiatrist-narcologist of the medical organization specified in paragraph 6 of this Procedure into the Medical record of the patient receiving medical care on an outpatient basis (form N 025/y).

If narcotic drugs, psychotropic substances and their metabolites are detected in a sample of a biological object (urine), a medical report on the absence of narcotic drugs, psychotropic substances and their metabolites in the human body is not issued.

23. If, during an examination by a psychiatrist, symptoms and syndromes of a disease are identified in the examined person, the presence of which is contraindicated in the possession of weapons, the examined person is sent for a psychiatric examination by a medical commission of a medical organization authorized by the federal executive body in the field of healthcare or the executive body of the subject. of the Russian Federation in the field of healthcare, in accordance with Article 6 of the Law of the Russian Federation of July 2, 1992 N 3185-1 “On psychiatric care and guarantees of the rights of citizens during its provision” (Gazette of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1992, N 33, Art. 1913, 2013, N 48, Art. 6165).

If the person being examined refuses to undergo the specified psychiatric examination, a certificate based on the results of the examination by a psychiatrist will not be issued.

24. Certificates based on the results of examinations by a psychiatrist, a psychiatrist-narcologist and an ophthalmologist are issued in accordance with the order of the Ministry of Health and Social Development of the Russian Federation dated May 2, 2012 N 441n “On approval of the Procedure for issuing certificates and medical reports by medical organizations” (registered by the Ministry of Justice of the Russian Federation on May 29, 2012, registration No. 24366).

25. The results of medical examinations carried out as part of a medical examination (including certificates based on the results of examinations by a psychiatrist, a psychiatrist-narcologist and an ophthalmologist) and laboratory tests, as well as a reasonable conclusion about the presence (absence) of medical contraindications to owning a weapon are entered by a doctor of the medical organization specified in paragraph 14 of this Procedure, in the Medical record of a patient receiving medical care on an outpatient basis (form N 025/у).

26. A medical report on the absence of medical contraindications to owning a weapon is drawn up by a doctor from the medical organization to which the person being examined has applied in accordance with paragraph 14 of this Procedure, based on certificates from medical specialists, the information specified in paragraph 25 of this Procedure, in the presence of the person being examined.

The validity period of a medical certificate stating that there are no medical contraindications to owning a weapon for obtaining a license to purchase a weapon is one year from the date of its issue.

If the person being examined refuses to undergo a medical examination or to undergo at least one of the medical examinations by medical specialists and laboratory tests provided for in paragraph 7 of this Procedure, as well as a chemical and toxicological study, issued in accordance with Article 20 of the Federal Law of November 21, 2011 N 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation” (Collected Legislation of the Russian Federation, 2011, No. 48, Art. 6724; 2013, No. 48, Art. 6165), a medical report on the absence of medical contraindications to owning weapons is not issued.

27. Issued medical reports on the absence of medical contraindications to the possession of weapons are subject to mandatory registration in the Register of issued medical reports on the absence of medical contraindications to the possession of weapons, the form of which is provided in Appendix No. 3 to this order.

16. The collection of samples of a biological object (urine) for sending for chemical-toxicological testing is carried out in a volume of at least 30 ml in a disposable container for collecting urine in the toilet room of the medical organization specified in paragraph 6 of this Procedure.

17. In order to exclude falsification of a sample of a biological object (urine), the following measurements are carried out during the first 5 minutes after its collection:

temperature using a non-contact device with automatic recording of measurement results (normally, the temperature should be within 32.5 - 39.0 °C);

pH using a pH meter or universal indicator paper (normally pH should be in the range of 4 - 8);

relative density (normally the relative density should be in the range of 1.008 - 1.025).

18. Upon completion of the preliminary chemical-toxicological study, if the biological object (urine) does not contain narcotic drugs, psychotropic substances and their metabolites in the sample, a confirmatory chemical-toxicological study is not carried out.

At the end of the preliminary chemical-toxicological study, if a biological object (urine) contains narcotic drugs, psychotropic substances and their metabolites in the sample, and regardless of their concentration, a confirmatory chemical-toxicological study is carried out. The delivery time for a sample of a biological object (urine) to a medical organization conducting a confirmatory chemical-toxicological study should not exceed 10 working days from the date of collection of the sample of a biological object (urine).

19. The period for conducting a confirmatory chemical-toxicological study should not exceed 3 working days from the moment the sample of the biological object (urine) is received by the chemical-toxicological laboratory.

20. Samples of biological objects (urine) are stored in a chemical-toxicological laboratory for 3 months from the date of conducting confirmatory chemical-toxicological studies, and the resulting mass spectra are stored in electronic form for five years.

21. The results of chemical and toxicological studies are reflected in a certificate of the results of chemical and toxicological studies (registration form N 454/u-06), which is drawn up in the form and in the manner approved by the order of the Ministry of Health and Social Development of the Russian Federation dated January 27, 2006. N 40 “On the organization of chemical-toxicological studies for analytical diagnostics of the presence of alcohol, narcotic drugs, psychotropic and other toxic substances in the human body” (registered by the Ministry of Justice of the Russian Federation on February 26, 2006, registration N 7544) and is submitted to the medical organization, sent a sample of a biological object (urine) to the chemical-toxicological laboratory.

At the request of the person being examined at the medical organization specified in paragraph 6 of this Procedure, he is given a copy of a certificate of the results of chemical and toxicological studies.

22. If, based on the results of a chemical-toxicological study, there are no narcotic drugs, psychotropic substances and their metabolites in a sample of a biological object (urine), a psychiatrist-narcologist of the medical organization specified in paragraph 6 of this Procedure shall issue a medical report on the absence of narcotic drugs in the human body drugs, psychotropic substances and their metabolites, the form of which is provided in Appendix No. 4 to this order, in two copies. One copy of the specified medical report is given to the examinee, the second copy is entered by the psychiatrist-narcologist of the medical organization specified in paragraph 6 of this Procedure into the Medical Record

If narcotic drugs, psychotropic substances and their metabolites are detected in a sample of a biological object (urine), a medical report on the absence of narcotic drugs, psychotropic substances and their metabolites in the human body is not issued.

23. If, during an examination by a psychiatrist, symptoms and syndromes of a disease are identified in the examined person, the presence of which is contraindicated in the possession of weapons, the examined person is sent for a psychiatric examination by a medical commission of a medical organization authorized by the federal executive body in the field of healthcare or the executive body of the subject. of the Russian Federation in the field of healthcare, in accordance with Article 6 of the Law of the Russian Federation of July 2, 1992 N 3185-1 “On psychiatric care and guarantees of the rights of citizens during its provision” (Gazette of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1992 , N 33, Art. 1913, 2013, N 48, Art. 6165).

If the person being examined refuses to undergo the specified psychiatric examination, a certificate based on the results of the examination by a psychiatrist will not be issued.

24. Certificates based on the results of examinations by a psychiatrist, a psychiatrist-narcologist and an ophthalmologist are issued in accordance with the order of the Ministry of Health and Social Development of the Russian Federation dated May 2, 2012 N 441n “On approval of the Procedure for issuing certificates and medical reports by medical organizations "(registered by the Ministry of Justice of the Russian Federation on May 29, 2012, registration No. 24366).

25. The results of medical examinations carried out as part of a medical examination (including certificates based on the results of examinations by a psychiatrist, a psychiatrist-narcologist and an ophthalmologist) and laboratory tests, as well as a reasonable conclusion about the presence (absence) of medical contraindications to owning a weapon are entered by a doctor of the medical organization specified in paragraph 14 of this Procedure, in the Medical record of a patient receiving medical care on an outpatient basis (form N 025/у).

26. A medical report on the absence of medical contraindications to owning a weapon is drawn up by a doctor from the medical organization to which the person being examined has applied in accordance with paragraph 14 of this Procedure, based on certificates from medical specialists, the information specified in paragraph 25 of this Procedure, in the presence of the person being examined.

The validity period of a medical certificate stating that there are no medical contraindications to owning a weapon for obtaining a license to purchase a weapon is one year from the date of its issue<1>.

If the person being examined refuses to undergo a medical examination or to undergo at least one of the medical examinations by medical specialists and laboratory tests provided for in paragraph 7 of this Procedure, as well as a chemical and toxicological study, issued in accordance with Article 20 of the Federal Law of November 21, 2011. N 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation” (Collected Legislation of the Russian Federation, 2011, N 48, Art. 6724; 2013, N 48, Art. 6165), a medical report on the absence of medical contraindications to gun ownership is not issued .

27. Issued medical reports on the absence of medical contraindications to the possession of weapons are subject to mandatory registration in the Register of issued medical reports on the absence of medical contraindications to the possession of weapons, the form of which is provided in Appendix No. 3 to this order.

On January 1, 2017, Order of the Ministry of Health of the Russian Federation dated June 30, 2016 No. 441n “On the procedure for conducting a medical examination for the presence of medical contraindications to the possession of weapons and chemical and toxicological studies of the presence of narcotic drugs, psychotropic substances and their metabolites" (hereinafter referred to as the Order).

Federal Law of December 13, 1996 No. 150-FZ “On Weapons” regulates legal relations arising during the circulation of civilian, service, as well as military hand-held small arms and bladed weapons on the territory of the Russian Federation, is aimed at protecting the life and health of citizens, property, and ensuring public safety , nature conservation and natural resources, ensuring the development of sports related to the use of sporting weapons, strengthening international cooperation in the fight against crime and the illegal proliferation of weapons.

A medical examination is carried out in order to establish in a citizen of the Russian Federation who intends to own a weapon, the presence (absence) of diseases included in the List of diseases, the presence of which prohibits the possession of weapons, approved by Decree of the Government of the Russian Federation of February 19, 2015 N 143.

Thus, the Order updated the procedure for conducting a medical examination to determine the presence of medical contraindications to gun ownership.

The mechanism for examining a person for the right to own a weapon is described in detail. As a result, the number medical research increased.

When undergoing a medical examination, a chemical and toxicological examination will be required to determine the presence in the body of narcotic drugs, psychotropic substances and their metabolites - opiates, cocaine, barbiturates and other prohibited substances. Research will be carried out in drug treatment clinics and other government and municipal institutions.

The requirements for medical organizations conducting medical examinations and examinations of specialists have also changed. Now such an examination must be carried out in a state or municipal medical organization at the place of residence or stay.

Once again, the Russian government has clarified the list of diseases for which it is prohibited to own civilian weapons. There are two groups of diseases for which the possession of weapons is strictly prohibited: any mental disorders and diseases of the eye and its appendages. As for the ophthalmologist's patients, everything is simple: we are talking about people who see practically nothing - who have a 70 percent loss of vision; lenses and glasses do not help.

In order to prevent violations of the requirements of the Federal Law dated December 13, 1996 No. 150-FZ “On Weapons,” the district prosecutor’s office explains that from January 1, 2017, Order of the Ministry of Health of Russia dated June 30, 2016 N 441n “On the procedure for conducting a medical examination for the presence of medical contraindications to the possession of weapons and chemical and toxicological studies of the presence in the human body of narcotic drugs, psychotropic substances and their metabolites" which determines that a medical examination for the presence of medical contraindications to the possession of weapons is carried out in order to determine the presence (absence) of a citizen of the Russian Federation intending to own a weapon ) diseases included in the List of diseases, the presence of which prohibits the possession of weapons, approved by Decree of the Government of the Russian Federation of February 19, 2015 No. 143.

Chemical-toxicological research is carried out for the purpose of detection and subsequent identification of narcotic drugs, psychotropic substances and their metabolites in samples of biological objects (urine). Medical examination is carried out in medical and other organizations engaged in medical activities, regardless of their organizational and legal form, which have a license to carry out medical activities that include the performance of work (services) on “medical examination for the presence of medical contraindications to the possession of weapons”, “ophthalmology” .

An examination by a psychiatrist and a psychiatrist-narcologist is carried out in a medical organization of the state or municipal health care system at the place of residence (stay) of a citizen of the Russian Federation undergoing a medical examination, which has a license to carry out medical activities involving the performance of relevant work (services).

The order also provides for: the procedure for conducting a medical examination and chemical-toxicological study; stages of chemical and toxicological research; duties of the medical registrar of the medical organization conducting the examination; timing of research; storage periods for biological objects (urine) in a chemical and toxicological laboratory; validity period of a medical certificate confirming the absence of medical contraindications to owning a weapon (1 year from the date of its issue).

The appendix to the Order contains forms of a medical report confirming the absence of medical contraindications to gun ownership; a journal of registration of issued medical reports on the absence of medical contraindications to gun ownership; medical certificate confirming the absence of narcotic drugs, psychotropic substances and their metabolites in the human body.

At the same time, when carrying weapons, citizens are required to have documents proving their identity (passport or service ID, hunting license, etc.), as well as a license or permit issued by internal affairs bodies to store and carry their weapons. The absence of these documents while carrying a weapon constitutes an administrative offense provided for in Part 4 of Article 20.8 of the Code of Administrative Offenses of the Russian Federation.

Storage of weapons and ammunition must be carried out using technical security means (metal cabinets, burglar alarm etc.). For violation of these rules, as well as for storing cartridges in excess of the permitted volume, administrative liability is provided under Part 4 of Article 20.8 of the Code of Administrative Offenses of the Russian Federation in the form of an administrative fine in the amount of 500 to 2000 rubles.

Weapons are subject to registration with the internal affairs agency at the place of residence within two weeks from the date of its acquisition. A month before the license or permit expires, the weapon is re-registered. The owner of a registered weapon, when changing his place of residence, is obliged to contact the internal affairs body with a request to remove the weapon from registration, indicating the address of the new place of residence.

In addition, for violation of the deadlines for registration (re-registration) of weapons acquired under licenses from internal affairs bodies, including the deadlines for registering them with internal affairs bodies when a citizen changes his place of residence, the guilty person is subject to administrative liability under Article 20.11 of the Code of Administrative Offenses of the Russian Federation. Punishment for citizens under Part 1 of Article 20.11 of the Code of Administrative Offenses of the Russian Federation is provided in the form of a warning or the imposition of an administrative fine in the amount of 1,000 to 3,000 rubles.

It also provides for administrative liability for firing weapons in places not designated for this purpose (both in populated areas and outside settlements) under Article 20.13 of the Code of Administrative Offenses of the Russian Federation. The offense is punishable by an administrative fine in the amount of 40 to 50 thousand rubles with confiscation of weapons and ammunition.

In addition, for careless storage of a firearm that created conditions for its use by another person, if this resulted in the death of a person or other grave consequences, the guilty person is subject to criminal liability under Article 224 of the Criminal Code of the Russian Federation. This crime is punishable by a fine of up to 100 thousand rubles, or compulsory labor for up to 360 hours, or correctional labor for up to one year, or restriction of freedom for up to one year, or arrest for up to six months.


Starting from the new year, the number of studies during medical examinations for the presence of medical contraindications to gun ownership will be increased by one more. The corresponding order of the Ministry of Health of Russia was registered on November 25 (Order of the Ministry of Health of Russia dated June 30, 2016 No. 441n “On the procedure for conducting a medical examination for the presence of medical contraindications to the possession of weapons and chemical and toxicological studies of the presence of narcotic drugs, psychotropic substances and their metabolites in the human body”, further - Order of the Ministry of Health of Russia dated June 30, 2016 No. 441n).

Thus, when undergoing a medical examination, a chemical and toxicological study will be required to determine the presence of narcotic drugs, psychotropic substances and their metabolites (opiates, cocaine barbiturates, etc.) in the body. Such studies will be carried out in drug treatment clinics and other state and municipal institutions (clause 3 of the Procedure for conducting a medical examination for the presence of medical contraindications to the possession of weapons and chemical and toxicological studies of the presence of narcotic drugs, psychotropic substances and their metabolites in the human body, approved by order of the Ministry of Health Russia dated June 30, 2016 No. 441n, hereinafter referred to as the new Procedure).

The changes will also affect both the requirements for medical organizations conducting medical examinations and examinations of specialists, and the procedure for conducting the examinations themselves. Thus, an examination by a psychiatrist will have to be carried out in a state or municipal medical organization at the place of residence (stay). For such a medical organization it is mandatory:

Availability of a license to carry out medical activities, providing for the performance of work (services) in “psychiatry” and “psychiatric examination”;

The presence of a medical-psychiatric commission approved by order of the Russian Ministry of Health or the regional health department (clause 5 of the new Procedure).

If, during the examination, a psychiatrist identifies symptoms or syndromes of a disease in the presence of which possession of a weapon is contraindicated, he will refer the person being examined for a psychiatric examination by a medical commission (clause 23 of the new Procedure).

An examination by a psychiatrist-narcologist should also be carried out in a state or municipal organization at the place of residence (stay) of the person being examined. As in the first case, if during the examination the psychiatrist-narcologist identifies symptoms or syndromes of the disease, in the presence of which possession of a weapon is contraindicated, he will refer the citizen for additional research (qualitative and quantitative determination of carbohydrate-deficient transferrin (CDT) in blood serum) (Clause 6 of the new Order).

In addition to these changes, the validity period of the conclusion based on the results of the medical examination will increase - if previously it was six months (paragraph 3 of the letter of the Ministry of Health and Social Development dated March 13, 2009 No. 14-6/307080/L), it will now be one year from the date of its issue (paragraph 2, paragraph 26 of the new Order).

And finally, new forms of medical reports on the absence of medical contraindications to gun ownership will appear (Appendices No. 2; 4 to Order of the Russian Ministry of Health of June 30, 2016 No. 441n).

Let us note that at present, in order to obtain a certificate of the absence of medical contraindications to owning a weapon, it is enough to go through the following specialists at an organization of any form of activity:

General practitioner;
-psychiatrist;
-narcologist;
- an ophthalmologist (paragraph 2, clause 2 of the Order of the Ministry of Health of the Russian Federation of September 11, 2000 No. 344 “On medical examination of citizens for issuing a license to purchase weapons”).

The Russian government has expanded the list of diseases that prevent the ownership of civilian and service weapons. Decree of the Government of the Russian Federation dated February 19, 2015 N 143 Moscow On approval of the list of diseases in the presence of which the possession of weapons is contraindicated, and on amendments to the Rules for the circulation of civilian and service weapons and cartridges for them on the territory of the Russian Federation comes into force from March 4, 2015.

The previous edition of the rules for the circulation of weapons indicated that licenses for weapons are not issued, in particular, in the presence of chronic and protracted mental disorders with severe persistent or often exacerbating painful manifestations, as well as in patients with alcoholism, drug addiction or substance abuse.

The new one approved by the Cabinet specifies a specific list of such deviations: in particular schizophrenia, schizotypal and delusional disorders, mood disorders (affective disorders), neurotic, stress-related and somatoform disorders, personality and behavior disorders in adulthood, mental retardation.

Thus, citizens who have diseases of the eye and its appendages, accompanied by a decrease in visual acuity below 0.5 by better eye and below 0.2 in the worse eye, or below 0.7 in one eye in the absence of vision in the other, or in case of intolerance to correction (spectacles, contact) in two open eyes, as well as accompanied by a concentric narrowing of the field of vision of each eye to 20 degrees or less.

The Government of the Russian Federation decides:

1. Approve the attached list of diseases, the presence of which prohibits the possession of weapons.


2.
